2018 Natural Gas Customer Terms and Conditions

The following terms and conditions (Terms and Conditions) apply to the 2018 Natural Gas Cash Back offer
 
  1. Information on how to participate in this offer and claim your cash back form part of these Terms and Conditions. Participation is deemed acceptance of these Terms and Conditions.
  2. These Terms and Conditions apply to the offer of a VISA Card (Jemena Cash Back Card) issued by iGoDirect Pty Ltd ABN 17 110 897 320, where applicable, when eligible individuals satisfy the requirements outlined in these Terms and Conditions.
  3. The "Promoter" is Jemena Gas Networks (NSW) Ltd (ABN 87 003 004 322), 99 Walker Street, North Sydney, NSW, 2060 (Jemena).
  4. To be eligible to participate in and claim this offer, individuals must purchase and install a Natural Gas appliance (hot water system,   ducted heating system,   flued heaters, portable heater, outdoor heater , cooktop, BBQ or pool/spa heater) as a replacement for their existing non-Natural Gas appliance between 1 April 2018 and 31 October 2018, and have the Natural Gas appliance claim submitted by 30 November 2018.
  5. This offer is available only to residential customers aged 18 years and over who live within the Jemena Gas Networks region in NSW and satisfy the purchase and installation requirements stated in these Terms and Conditions. Individuals who purchase Natural Gas appliances for government projects, new homes, commercial projects, property developments or the replacement of existing Natural Gas appliances will be ineligible to participate or claim. To check if they fall within the Jemena Gas Networks region, individuals should contact a natural gas specialist listed on www.gonaturalgas.com.au/gas-plumbers-and-fitters (Natural Gas Specialist) or refer to the Natural Gas Locator Tool on www.gonaturalgas.com.au/check-for-natural-gas. The purchase and installation of the Natural Gas appliance must be made from and conducted by a Natural  Gas Specialist in the Jemena Gas Network region. Claims will not be accepted:
  1. For purchases that have been made and for which a Jemena Cash Back Card has been issued under these Terms and Conditions or under any previous offer, and;
  2. On back-ordered or forward-ordered products or inability of the Natural Gas Specialist to undertake the installation within the promotion dates for any reason. There is a maximum of three cards claimable per residence unless the Promoter, at its sole discretion, decides to increase the maximum per residence. Only one free basic Natural Gas connection (if required and where applicable) will be offered per residence/household.
  1. This offer cannot be used in conjunction with any other Jemena offer, including any bespoke 2018 campaign offers in the market through our current alliance partner.
  2. The Jemena Cash Back Card claims will allow for up to 2,000 claims for Natural Gas appliances or up until the end of the campaign. Each valid Jemena Cash Back Card has a value of $1,000 (Natural Gas ducted heating systems, Natural Gas log fires and Natural Gas pool/spa heaters only), $500 (Natural Gas hot water systems) or $150 (Natural Gas portable heaters, Natural Gas BBQs, Natural Gas outdoor heaters and Natural Gas Cooktops). The Jemena Cash Back Cards include GST.
  1. Once a Natural Gas Specialist has installed the Natural Gas appliance, the Natural Gas Specialist will then assist the individual by providing a correctly completed copy of the Gas Compliance Certificate and a copy of the appliance Purchase Receipt.
  2. If all documentation is correct, individuals can lodge a claim, in accordance with these Terms and Conditions, to receive a Jemena Cash Back Card by visiting www.naturalgascashback.com.au and submitting the online claim form by 11:59pm on 30 November 2018. The individual will need to submit the following with the online claim form: meter number, installer business name, old and new appliance details (i.e. details of  their old heater and their new heater), a copy of their Gas Certificate of Compliance and a copy of their Purchase Receipt as proof of purchase. The steps to claim and use your Jemena Cash Back Card are as follows:
  1. Make your appliance purchase and retain your Purchase Receipt.
  2. Have your appliance installed and receive your Gas Certificate of Compliance.
  3. Fill out and lodge the online claim form, uploading your Purchase Receipt and Gas Certificate of Compliance.
  4. Once your lodgement is confirmed, you should receive your Jemena Cash Back Card with PIN by mail within 30 business days.
  5. Once you receive your card in the mail, activate it online via www.naturalgascashback.com.au or by calling iGoDirect on 1800 427 608 within 3 months of the date on the letter provided with the card. The Jemena Cash Back Card will be ready to use from 12pm the business day following activation, and will expire 12 months from the date of activation.
  6. Start using your Jemena Cash Back Card at any payment terminal accepting VISA Australia wide.
  1. The Promoter will endeavour to ensure that eligible customers who lodge valid claims receive their Jemena Cash Back Card within 30 business days of lodgement of a valid claim.
  2. Eligible purchases and installs must take place between 1 April 2018 and 31 October 2018 and the claim must be submitted by 30 November 2018.. Claim forms will not be accepted after 30 November 2018. This includes all re-submissions or previously rejected claims
  3. The Jemena Cash Back Card will be posted to the installation address provided on the claim form. To the extent permitted by law, the Promoter takes no responsibility for cards not received. The Promoter will not be responsible to the individual for non-activated Jemena Cash Back Cards or expired cards.
  4. Customers will be disqualified from this promotional offer if they fail to comply with any of the specified Terms and Conditions. By making a claim, all individuals agree to comply with these Terms and Conditions.
  5. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and reward suppliers. Claims are conditional on providing this information. By entering this promotion, individuals consent to receiving information on Natural Gas retail offers for an indefinite period unless otherwise advised by them. The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988 (Cth). Individuals can opt out of receiving further information, access and correct the personal information the Promoter holds about the individual by contacting the Promoter by email at privacyenquiries@jemena.com.au. The Promoter's full privacy policy can be viewed at www.jemena.com.au/about/privacy.aspx. All claims become the property of the Promoter.
  6. The VISA gift card (defined as Jemena Cash Back Card in these Terms and Conditions) is issued by iGoDirect and terms and conditions apply, visit www.naturalgascashback.com.au for details. The VISA card will be issued with an activation letter detailing that the card must be activated within 6 months from the date on the letter, that the card is valid for 12 months from the date of activation, and basic terms of use of the VISA card. It is each individual's responsibility to review the iGoDirect terms and conditions carefully. Acceptance of these Terms and Conditions is deemed to include acceptance of the iGoDirect terms and conditions.
  7. The Promoter reserves the right, at any time, to verify the validity of claims and individuals (including an individual's identity, age and place of residence) and to disqualify any individual who submits a claim that is not in accordance with these Terms and Conditions or who tampers with the claim process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  8. The Promoter's decision is final and no correspondence will be entered into.
  9. If for any reason an individual does not take/redeem an offer (or an element of an offer) by the time stipulated by the Promoter, then the offer (or that element of the offer) will be forfeited. The Jemena Cash Back Card must be activated by the expiry date shown on the card. Cards will not be activated after their expiry date.
  10. If any offer (or part of any offer) is unavailable, the Promoter, in its discretion, reserves the right to substitute the offer (or that part of the offer) with an offer to the equal value and/or specification.
  11. Jemena Cash Back Cards, or any unused portion of a Jemena Cash Back Card, are not transferable or exchangeable and cannot be taken as cash.
  12. If this promotion is interfered with in any way or is not capable of being conducted as anticipated by the Promoter due to any cause beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any individual; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.
  13. Any cost associated with accessing the promotional website is the individual's responsibility and is dependent on the internet service provider used.  
  14. Nothing in these Terms and Conditions limits excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well  as any other implied warranties under the ASIC Act 2001 (Cth) or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its ‘related bodies corporate’ as defined in the Corporations Act 2001 (Cth) and respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  15. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any cause beyond the reasonable control of the Promoter; (d) any variation in offer value to that stated in these Terms and Conditions; (e) any tax liability incurred by an individual; or (f) use/taking of/redemption of an offer.
  16. As a condition of claiming an offer, each individual must sign any legal documentation as and in the form required by the Promoter and/or Jemena Cash Back Card suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

 2018 Natural Gas Alliance Partner Rewards Terms and Conditions

  1. The Promoter is Jemena Gas Networks (NSW) Ltd (ABN 87 003 004 322), Level 14, 99 Walker Street, North Sydney, NSW, 2060 (Promoter).
  2. Information published by the Promoter on how to enter and on the prize form part of the terms and conditions of entry (Terms and Conditions). Entry into this competition deems acceptance of these Terms and Conditions. This offer is not valid in conjunction with any other offer.
  3. To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.
  4. Entry to the competition is open to gas specialists who trade within the Jemena Gas Network region*  in NSW confirmed as natural gas alliance partners by the Promoter who have fulfilled the requirements set out below (Eligible Entrants). Entry to this competition is not open to consumers.
  5. The competition commences on 1 April 2018 and ends at 11:59pm AEDT on 30 November 2018 (the Promotional Period). Entries will not be accepted after 30 November 2018.This includes all re- submissions or previously rejected entries.
  6. The competition may be entered by Eligible Entrants during the Promotional Period as follows:
    1. Eligible Entrants must register their business details online at naturalgascashback.com.au/trade.
    2. Eligible Entrants that arrange new gas connections to a residential dwelling in the Jemena Gas Network (New Gas Connections) in conjunction with the sale and installation of a natural gas ducted heating system, hot water system, flued heater, pool/spa heater, portable heater, outdoor heater or BBQ/cooktop product (Natural Gas Appliance) that replaces a non-gas appliance between 01/04/18 and 30/11/18 are eligible to earn points.
    3. One point equals one competition entry. The number of points that may be earned for each New Gas Connection and Natural Gas Appliance are as follows:
      1. New Gas Connections = 10 points
      2. Ducted heating system = 7 points
      3. Hot water system = 5 points
      4. Flued heater = 5 points
      5. Pool/spa heater = 5 points
      6. Portable/Outdoor heater = 2 points
      7. BBQ/cooktop/ = 1 point
    4. Entries must be submitted electronically by visiting www.naturalgascashback.com.au/trade and submitting an online claim form including (a) the ‘request for service’ reference number provided by Jemena or energy retailer (as applicable) when the New Gas Connection request is lodged, (b) proof of purchase for the Natural Gas Appliance purchased by the end customer and, (c) the certificate of compliance for the Natural Gas Appliance installation.
  7. New Gas Connection requests must be lodged via an energy retailer or Jemena directly between 9:00am AEDT 1 April 2018 and 5:00pm AEDT 30 November 2018 and entries must be submitted via www.naturalgascashback.com.au/trade by 30 November 2018. Entries will be deemed to be accepted at the time of receipt of the entry by the Promoter and not at the time of transmission.
  8. Natural gas alliance partners are only entitled to submit entries in respect of an existing residential dwelling if they have authority from the relevant owner to request a new connection to that existing dwelling.
  9. If the Promoter validly declines or refuses any New Gas Connection request or installation under relevant laws, the New Gas Connection request will not be a valid entry under this offer.
  10. Only one New Gas Connection request can be made by an Eligible Entrant in respect of any existing dwelling.
  11. If, prior to the Eligible Entrant submitting a New Gas Connection request to the Promoter, a New Gas Connection request in respect of that existing dwelling has already been submitted, then the Eligible Entrant will not be entitled to enter the competition in respect of that New Gas Connection request for that existing dwelling.
  12. To check if a property address falls within the Jemena Gas Network region, Eligible Entrants should lodge a new connection request via an energy retailer or Jemena directly or refer to the Promoter’s online gas availability tool at www.gonaturalgas.com.au.
  13. Natural gas alliance partners who sell and install a Natural Gas Appliance which relies on natural gas as its main energy source for a government project, new home, commercial project, property development or the replacement of an existing natural gas Appliance (gas to gas) will be ineligible to participate or claim in this offer.
  14. Entries must include all requested contact details to be eligible to win. Inaudible, incomprehensible, illegible, inappropriate or incomplete entries will be deemed invalid.
  15. There are four prizes available to be won. First prize is a 2017 Ford Mustang Fastback, Automatic, valued up to AU$60,000. (inclusive of GST). There are also three Flight Centre holiday vouchers valued at AU$10,000 (x1) and AU$5,000 (x2).
  16. The prize value of the vehicle includes stamp duty, 12 months registration and compulsory third-party insurance.
  17. The Promoter takes no responsibility for petrol, comprehensive insurance, health, transport, body, paint or mechanical damage, or any other costs or damages, from date of pick-up.
  18. The winner will be required to pick up the prizes from a location nominated by the Promotor.
  19. The winner will be required to have photos taken at the pick-up location. The Promoter may use these photos in media and for any other use at their discretion.
  20. The winner will be responsible for any expenses incurred in getting to the pick-up location and for collecting the prize on a day to be agreed between the winner and the Promoter.
  21. The prize winners will be the first entries drawn electronically at the premises of Jemena Gas Networks (NSW) Ltd (ABN 87 003 004 322), 99 Walker Street, North Sydney, NSW, 2060 at 11:00am AEDT on 10 December 2018.
  22. There must be a different winner for each of the four prizes. Entrants cannot win more then one prize. If an entrant’s name is drawn twice, redraws will take place until a different entrant is drawn for the second prize.
  23. The winners will be notified by phone and mail within five (5) business days of the draw and their names published on the Promoter’s website (www.gonaturalgas.com.au) from 14 December 2018 for 28 days.
  24. Should a prize remain unclaimed three months after the original draw (11:00am AEDT on 11 March 2019), the Promoter may conduct a further draw as is necessary in order to distribute the prize, at the same place as the original draw at 11:30am AEDT on 11 March 2019. The winner of this draw will be notified by phone and mail within two (2) business days of the unclaimed prize draw.
  25. If the prize is unavailable, for whatever reason, then the Promoter reserves the right to substitute the prize for a prize of equal or greater value. It is a condition of accepting a prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements.
  26. The Promoter reserves the right to conduct a redraw in the event that an entrant, claiming to be a winner, is unable to satisfy these Terms and Conditions or has breached these Terms and Conditions.
  27. The Promoter’s decision in relation to any aspect of the competition is final and binding on each person who enters. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries.
  28. The Promoter accepts no responsibility for any loss, damage or liability caused in connection with this offer.
  29. By participating in this competition, the winner agrees to participate and co-operate as required in all editorial activities relating to the competition, including but not limited to being interviewed and photographed. The winners (and any companions) agree to grant the Promoter a perpetual, irrevocable and exclusive licence to use such footage and photographs in all media worldwide, including online social networking sites, and the winners (and any companions) will not be entitled to any fee for such use.
  30. The Promoter reserves the right to amend, cancel or suspend this competition if an event beyond the control of the Promoter corrupts or affects the administration security, fairness, integrity or proper conduct of this competition. The Promoter will disqualify any individual who has tampered with the entry process or any other aspect of this competition.
  31. Any cost associated with entering the competition is the entrant's responsibility.
  32. Nothing in these Terms and Conditions limit, exclude or modify or purport to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth)  or any other implied terms, conditions or warranties under other legislation (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including liability under the Non- Excludable Guarantees, the Promoter (including its officers, employees and agents) excludes all liability (including in negligence) for any personal injury or death; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition and promotion.
  33. Except for any liability that cannot by law be excluded, including liability under the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) is not responsible for and excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after its receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize by any person. The Promoter (including its officers, employees and agents) excludes all liability for any loss (including, without limitation, indirect, special or consequential loss or loss of profits or opportunity), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition including taking or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law), including the Non-Excludable Guarantees. Any change in value of a prize occurring between the publishing date and date the prize is claimed is not the responsibility of the Promoter.
  34. The Promoter collects personal information in order to conduct the competition and may disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and to Australian regulatory authorities. Entry is conditional on this information being provided. By entering, entrants consent to the Promoter and any other third party nominated by the Promoter using the information for current and future promotional, marketing, publicity and research purposes, including sending messages or telephoning entrants. Entrants can request access to update  or correct their personal information held by the Promoter and may request that they not receive further promotional or marketing communications by contacting the Promoter. All personal information will be securely stored by the Promoter.
